A preliminary injunction due to EU-trademark infringement has been served on us: what to do?

Once a preliminary injunciton (aka interim injunction) has been served on the opponent it is valid. Consequently, it needs to be complied with. Otherwise, there is the danger of very substantial consequences. In particular, there is the imminent threat that the court imposes heavy fines on the opponent in case of violation of the injunction. At least, this is the case under German law.

Hence, it is strongly advised that you contact a lawyer with experience and expertise in EU trademark law. Preferably this lawyer practises in the jurisdiction of the respective court. He/she will then review the matter and recommend an appropriate reaction.
